The Committee granted a deferment to Mr Yanagida’s suspension pursuant to Rule 1106(2).
Accordingly, Mr Yanagida’s license to ride in races is suspended for a period to commence after racing on 29 February 2020 and conclude after racing on 13 March 2020.
Facts:
Following the running of race 10, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Mr Yanagida allowed his mount DAWON to shift out when not sufficiently clear of SACRED CAGA which was checked near the 300 metres.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Yanagida said that he understood the Rule and confirmed he admitted the breach.
Mr Harris supported Mr Yanagida at the hearing.
Mr Jones demonstrated the incident using the available video footage. He identified that Mr Yanagida was riding DAWON forward and he allowed his mount to shift out into the line of SACRED CAGA. He identified that when Mr Yanagida commenced his shift outwards, he was only half a length in advance of SACRED CAGA which was checked.
Mr Yanagida said that he agreed with Mr Jones’ interpretation of the incident and had nothing to add.
Mr Harris advised that earlier in the day Mr Yanagida was warned by the Stewards for shifting ground when not sufficiently clear. He said that Mr Yanagida’s outward manoeuvre was not severe.
Submissions for Penalty:
Mr Williamson said that Mr Yanagida had one previous breach under this Rule in the last 12 months which was a very good record. He said the level of carelessness was low to mid-range and the aggravating factor was DAWON was relegated from 3rd to 4th place.
Mr Yanagida advised that his proposed suspension could start after racing on 29 February.
Mr Harris submitted that Mr Yanagida has a good record.

The Committee considered all the evidence and submissions presented.
When reviewing the video films, the Committee deemed the level of carelessness displayed by Mr Yanagida was mid-range. It was clear that Mr Yanagida allowed DAWON to shift out a total of 3 horse widths when only half a length clear of SACRED CAGA. Mr Yanagida failed to take reasonable steps to avoid causing interference to SACRED CAGA.
The JCA Penalty Guide starting point for mid-range carelessness is 8 national riding days which was adopted.
The aggravating factor was as a consequence of Mr Yanagida’s actions DAWON was relegated from 3rd to 4th place. This warranted a 1-day uplift in penalty.
The mitigating factors were Mr Yanagida’s admission of the breach and his very good record. For these combined factors he was afforded a 1-day reduction in penalty.
After taking into account all the above factors the Committee considered that an appropriate suspension was 8 national riding days.
