Facts:
Following the running of Race 7, Pryde’s Easifeed Southern Lights (Handicap Trot) (Gr3) 2700m, pursuant to Rule 870(3) Stipendiary Steward, Mr V Munro lodged an Information A10670 instigating a protest into the fourth placed horse by the judge, alleging that SMOKEY MAC (J Morrison) broke in excess of 150 Metres during the running.
Mr J Morrison, Trainer of Smokey Mac confirmed the information admitting the breach, and stating he did not contest the protest and did not want to be present at the hearing.
The Judges provisional placings were: -
1st - One Apollo
2nd - Dark Horse
3rd - Humble Ladd
4th - Smokey Mac
5th – Cuchulainn
Rule 870 (3) provides that, any horse which breaks from its gait shall promptly regain its proper gait.
Breaking Horse Regulations provide that:
(a) Any horse which breaks free from it gait either at the start or during then running of any race and continues on in the break for a distance of 150 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait
Where a protest has been duly lodged against the placing of an offending horse, the Judicial Committee shall either (i) relegate such horse under Rule 870(4) to behind any other horse in respect of which an advantage may have been gained; or (ii) disqualify it from the race under Rule 1003(2).
Submissions for Decision:
Stipendiary Steward, Miss R Hayley used the available Race films to identify SMOKEY MAC breaking around the first bend for approximately 180 metres before regaining its gait.
Mr Munro submitted that SMOKEY MAC finished in 4th placing and was in breach of Rule 870(3) and the Breaking Horse Regulations and as a result should be disqualified from the Race.
Reasons for Decision:
After hearing the submissions and reviewing the Race films, the Committee was satisfied that a clear breach of the Rules had occurred with SMOKEY MAC galloping for at least 180 metres as a result, SMOKEY MAC is in breach of the relevant Rule and Regulations.
