Following the running of Race 11 (Happy 60th Russell Wright Hdcp), Information No. A12929 was filed with the Judicial Committee. It was alleged that Mr Ormsby used his whip excessively prior to the 100m when riding EL LUCHADOR.
Mr Ormsby said that he understood the Charge and confirmed that he admitted the breach.
Ms Algar identified Mr Ormsby and his mount on the film replays and said that Mr Ormsby struck his mount 8 times with the whip before the 100m. (5 only, are permitted).
Mr Ormsby agreed with the number specified by Ms Algar.

Mr Jones said that Mr Ormsby had a clear record and that he only used limited force when striking his mount.
Mr Ormsby said that he did not realise that the strikes on the shoulder were also counted.

There were no reasons presented warranting a shift from that figure, accordingly the starting point was deemed an appropriate penalty.
