Facts:
Following the running of the UNITED SECURITY NORTHLAND MAIDEN, an Information was lodged by Senior Stipendiary Steward, Mr M Williamson against Jockey, Mr B May alleging that Mr May as the rider of KAPALKA allowed his mount to shift in near the 1300 metres mark contacting MOLLY'S GAME with that runner shifting in dictating MERSEY BEAT into the line of INCY WINCY SPIDER which had to be checked and thereby losing ground.
Rule 638(1)(d) provides : A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr May was present at the hearing and he confirmed that he understood the Rule and that he admitted the breach.
Stipendiary Steward, Mr A Coles demonstrated the incident by use of the race films. He identified Mr May's mount KAPALKA and to its inside was MOLLY'S GAME and inside that was MERSEY BEAT and then down on the inner was INCY WINCY SPIDER. He showed where shortly after the start Mr May began shifting in from 6 wide trying to obtain a better position and in doing so his horse made contact with MOLLY'S GAME. That horse was then moved inwards onto MERSEY BEAT which shied away from MOLLY'S GAME down onto INCY WINCY SPIDER which had to be checked and as a result lost ground.
Mr Coles said that the interference was not at the high end.
Mr May acknowledged that he was shifting over but did say that he was misled by the movements of the horses on his inside. He did say that MOLLY'S GAME had shifted out towards his horse.
When asked by the Chairman he did confirm that there was contact between his horse and MOLLY'S GAME.
He then said that he admitted the breach for shifting his horse inwards and bumping MOLLY'S GAME.
Submissions for Penalty:
Mr Williamson said that Mr May had one previous breach of this Rule and that was at Rotorua on the 26th of August and he received a 3 day suspension. He added that that was Mr May's only suspension since he began riding in New Zealand.
Mr Williamson then went on to say that the heavy contact caused by Mr May put MOLLY'S GAME off balance. He said that the shift was too abrupt.
He then said that the incident was in the low to middle range.
Mr May did not make any penalty submissions other than to point out what he perceived to be contributions from the other horses.
The Chairman asked Mr May if he wished to have a deferment of his suspension but after being granted time to check with his employer he said that the suspension could start immediately.

The race films give a very clear view of this incident. Mr May has moved his horse inwards shortly after the start and despite the contact with MOLLY'S GAME he still moved in further.
He has admitted the breach but that was inevitable bearing in mind the clear film evidence. In assessing penalty the Committee has taken a starting point of 4 days. A one day uplift has been given because of the previous breach and the number of horses involved. It has been assessed that this incident to be in the mid-range of seriousness.
The Committee has given Mr May a credit of one day for his admission of the breach and therefore the suspension will be one of 4 days.
