As Mr Riddell admitted the breach we find the charge proved.
Penalty:
We grant Mr Riddell's request to seek a deferment to his suspension as per Rule 1106(2).
Accordingly, we impose a suspension on Mr Riddell which will commence after racing on 2nd March and conclude after racing on 9th March 2013 (4 days).
Note
Later in the day Mr Riddell approached Mr Neal and requested for the hearing to be re opened on the basis Mr Riddell had new evidence. The Committee after a short deliberation and in order to be fair to Mr Riddell granted his request.
Mr Riddell told the Committee that his manager Mr Wall had been in contact with him and said he was offered the ride on ASHBURN LANE at Christchurch on March 7th. He said Mr Wall recently became involved in the ownership of the horse due to his recommendation. He advised the Committee ASHBURN LANE was placed 3rd yesterday at Riccarton when ridden by Mr D Bradley.
In response to a question from the Committee Mr Riddell was unable to explain why Mr Bradley was going to be replaced on the horse. He said when the horse had its previous start in the South Island he was suspended and unable to take the ride. Mr Riddell when questioned further said he did not see ASHBURN LANE race yesterday. We asked Mr Riddell if he intended to fly to Christchurch for the one ride, he said Ms Latta could possibly give him 2 other rides.
In response to a question from the Committee Mr Riddell said the last time he rode in the South Island outside of Cup week in November was at Ashburton in October.
The Committee asked Mr Neal for his assessment on the new evidence. He submitted it was clear Mr Riddell had not ridden in the South Island since cup week in November. He said he could understand Mr Riddell's position and the Committee had to decide whether we accept what he had now told us. He said we had to consider the fact it is not usual for Mr Riddell to ride in the South Island. He summed up by informing us Mr Riddell would ride in the South Island 2 to 3 times a year.
Mr Riddell confirmed to the Committee he rides 2 to 3 times a year in the South Island.
Decision
The Committee listened to Mr Riddell’s and Mr Neal's evidence.
The Committee is mindful of the need to treat all riders with fairness and consistency.
We highlighted to Mr Riddell the importance for him to have credible evidence of his future riding commitments prior to attending a hearing.
The Committee advised Mr Riddell that in order to change our original penalty he would need to present proper evidence of his riding commitments. He has not been able to do so.
Therefore the original decision stands.
Charge:
Following race 2, an information was filed pursuant to Rule 638(1)(d). The informant, Mr Neal alleged that Mr Riddell allowed his mount FASTFOOT to shift in when not clear of MRS NEAT (M Walker) which was had to check near the 900 metres.
Mr Riddell acknowledged that he understood the rule and the charge.
Facts:
Mr Williamson showed the Committee that prior to the incident occurring Mr Riddell's mount was commencing to move forward in a three wide position. He said the Stewards accept that FASTFOOT was not the easiest horse to ride. However, he pointed out to the committee that at the 900 metres, Mr Riddell allowed his mount to shift in when approximately ½ to ¾ length clear. In doing so this placed MRS NEAT in restricted room and she lost her rightful running line.
Mr Riddell told the Committee that the slow speed in the race had contributed to the incident. He said he went to go forward and his mount commenced to over race. He admitted shifting into Mr Walker's rightful running line when not the required distance clear.
Submissions for Penalty:
Mr Neal produced Mr Riddell's record which showed 4 previous breaches under this rule in the last 12 months. He said the level of carelessness was slightly below mid range and submitted his record was not unreasonable for the frequency of his riding. He acknowledged the slow pace and the racing manners of FASTFOOT were in mitigation. However, he submitted Mr Riddell had an obligation to be clear when shifting ground which today he failed to do so. He submitted he would let the Committee determine an appropriate penalty.
Mr Riddell submitted he had a ride in the Derby on March 2nd and was requesting a deferment to his proposed suspension. He further stated he had a ride in the Auckland Cup but understood he would be suspended on the day.
The Committee told Mr Riddell we were specifically interested to know if he was intending to ride at Christchurch on the 7th March. Mr Riddell said it was an option for him. When tested further Mr Riddell said he was not intending to ride at Christchurch on the 7th March. He advised us he last rode in the South Island during cup week in November.
In response to a question from the committee Mr Riddell said he was unable to tell us when he last rode at a mid week meeting in Christchurch outside of cup week. The Committee explained in detail to Mr Riddell that it is JCA policy to test all riders of their past and up future commitments. Mr Riddell acknowledged he understood the policy.
The Committee asked Mr Neal for his assessment on Mr Riddell's South Island commitments. He told the Committee that the computer records were unable to be generated to verify his history. However, he confirmed Mr Riddell had not ridden in the South Island for at least 4 months.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension for this careless riding charge. The mitigating factors are Mr Riddell's admission of the breach and we independently assess the level of carelessness was at the mid to low end. Upon reviewing the video films we accept that FASTFOOT was not racing tractably, however, we reminded Mr Riddell he is a very experienced rider. The aggravating factors are Mr Riddell allowed his mount to shift in when only ¾ of a length clear of MRS NEAT which resulted in her losing her rightful running line and we noted that Mr Riddell did not have any pressure on him from his outside. We assess his record as reasonable and we note today was his 5th breach in the last 12 months.
Mr Riddell by his own admission submitted he was not intending to ride at Christchurch on the 7th March therefore this date was not included in his penalty.
Mr Riddell had ample opportunity to contact his manger as the hearing took place after race 5.
Mr Riddell had no history of riding at Cromwell therefore the 3rd of March was not included in his penalty.
We note that 2 premier days were involved in his proposed suspension.
Taking into account all the above facts we assess an appropriate penalty is a 4 day suspension.
