The committee accordingly found the charge of careless riding proved.

Taking in to account all of these factors Mrs Allpress is suspended from the close of racing on Wednesday July 6th up to and including racing on Sunday July 10th – in effect 4 days.
Charge:
Following the running of Race 7 an Information was lodged by Stipendiary Steward Mr N Goodwin against Mrs L Allpress alleging a breach of Rule 638(1) (d).The Information stated that L Allpress the rider of I PAY allowed her mount to shift out near the home turn when not clear of HANDINHAND (B Lammas) which was forced over extra ground then had to be steadied and change ground to improve.
Facts:
Although there had been a protest lodged following this incident and evidence had been heard during the enquiry the Judicial Committee requested that Mr Goodwin show the films again.
He said that on the home turn Mrs Allpress shifted ground outwards looking for a better racing surface. She was not clear of Mr Lammas when she did so (which Mr Lammas confirmed during the protest hearing) and this was obvious by the way Mr Lammas’ mount had its head turned outwards as Mrs Alpress moved into its rightful line of running. Mr Goodwin said she had moved outwards a minimum of 2 horse-widths when only a bare length clear.
Mrs Alpress was adamant that she was always entitled to be where she was and that Mr Lammas was merely following her line.

Reasons for Decision:
The committee, having heard all the evidence and viewing the films, was satisfied that Mrs Allpress did move outwards when not the required distance clear of Mr Lammas. The head-on film clearly showed Mr Lammas taking a hold of his mount and then changing direction to an inside run. This only happened as a result of Mrs Allpress drifting outwards. The side on film confirmed that she was not the required distance clear when she did so.

Mr Goodwin advised the committee that Mrs Allpress was a national rider with an excellent riding record. He considered the breach to be at the lower end of carelessness but his submission was for a period of suspension.
Mrs Allpress had no submissions to make but advised the committee that she did not have any riding commitments within the next seven days.

In coming to a decision on penalty we considered all of the submissions. Mrs Allpress rode carelessly when she moved out taking the line of Mr Lammas. A protest was lodged following the incident by Mr Lammas which was ultimately unsuccessful however he was inconvenienced by the incident. It was our opinion that a period of suspension be imposed. We adopted a starting point of 5 days but took into account Mrs Allpress’s excellent record and the degree of carelessness. While Mr Lammas did suffer some interference it was not sustained and he was only held up for one stride.
