Facts:

Following the running of Race 1 Information No. A3136 was filed with the judicial committee. The information alleged that horse No.2 Sea King placed 1st by the judge interfered with the chances of horse No.8 Sea Eagle, placed 3rd by the judge, over the final stages.

The Rule was read with all parties agreeing that they understood the Rule.

The Judge’s placings were:

1st   Sea King
2nd  Ishidanzin
3rd  Sea Eagle
4th  Regal Secret

Margins: Nose, short-head, 1 length

Rule 642(1) reads:

If a placed horse or its rider causes interference within the meaning of this Rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred they may place the first mentioned horse immediately after the horse interfered with.

Submissions for Decision:

Mr Studd said that over the final stages his horse was intimidated by the inside horse (Sea King) and forced off the running line he had been on and it interfered with his riding over the final stages of the race. He said he had tried to keep his horse straight but it was forced outwards. Mr Studd said that he stopped riding about 50-70m from the finish, but that he could not be sure due to a lack of lines on the track at the finish of the race.

Ms Little said that by being pushed out it had just about cost her horse winning, and that Sea Eagle does take some time to wind up. She added that Mr Studd had covered all other matters.

Mr Harrison said that his horse “Sea King” was clearly going to win and any contact made was on the line or past it and that his horse was going the better. He added that he didn’t believe Mr Studd had stopped riding at all and that the interference had not affected the chances of Sea Eagle.

Ms Veenendaal said that Sea King had come from behind Sea Eagle and that her horse was travelling better than Sea Eagle and that it was also an inconvenience to her horse as she had stopped riding it out. She said that her mount did shift out but that Sea Eagle shifted in and that Sea Eagle had had its chance to go past her but it couldn’t.

Mr Goodwin said that Sea Eagle was forced off its line over the final stages and did not believe that there was any inward movement from Sea Eagle. He said that as the interference took place close to the finish line it was not conclusive that Sea Eagle would have beaten Sea King home if interference had not taken place.

Reasons for Decision:

The committee gave due consideration to all of the submissions plus the video evidence. It found that Sea King did shift out into the running line of Sea Eagle and that Sea Eagle’s rider was forced to stop riding his mount out just prior to the finish of the race. The committee observed that Sea King finished strongly to the winning post and appeared to be holding Sea Eagle prior to the interference occuring.

Taking into account the above plus the margins (nose, short-head), the degree of interference and where it occurred the committee was not satisfied that if interference had not taken place that Sea Eagle would have beaten Sea King.
