Charge:

Alleged that M Hamilton trainer of "Annachan" failed to declare any gear for this horse. "Annachan" raced in side winkers.

Facts:

Mr Davidson told the hearing that Mr Hamilton did not declare any gear for the horse "Annachan" prior to the meeeting. It was the horse's first start at a race meeting. It had run a trial in side winkers and clearly, Mr Hamilton omitted to notify the Stipendiary Stewards of the fact that he wished to race the horse in such gear.

Submissions for Penalty:

Mr Davidson advised the hearing that a public announcement was made before the race so that the betting public were made aware of the gear that the horse was wearing in the race. He submitted that a fine in the region of $75 to $100 was appropriate.

Reasons for Penalty:

Having considered the matter we were satisfied that Mr Hamilton had simply overlooked the requirement to notify the Stipendiary Stewards of the fact that the horse would race in side winkers.
