Facts:
At the conclusion of race 7 N.A and M.A Evans and Bay Road Service Centre Handicap an information was lodged by Stipendiary Steward Mr M Davidson alleging that Apprentice Jockey Miss R Black struck her horse HEART OF HEARTS excessively prior to the 200 metre mark.
Rule 638(3)(b) reads: A rider shall not (b) strike a horse with a whip in a manner to an extent which is unnecessary, excessive or improper.
Miss R Black admitted the breach.
Submissions for Decision:
Miss Black stated she had made an error of judgment and that she had realised “too late and was very sorry”.
Miss Black said her horse had responded initially but had nothing left after the 200 metre mark.
Reasons for Decision:
The video evidence was very compelling, highlighting Miss Black striking her horse eleven times between the 400 and 200 metre mark. The rule is clear a jockey may not strike a horse more than six times up to the 200 metre mark without taking a break.

Stipendiary Steward Mr M Davidson stated that this was Miss Black’s second breach of this rule under the “excessive” clause in the past twelve months.
Miss Black was fined $350.00 on January 5 at the Greymouth Meeting for her previous breach.
Mr Davidson recommended to the Committee a penalty of a suspension or a substantial fine would be appropriate.
Miss Black stated she would like the Committee to consider a fine.
