Charge:
At the conclusion of Race 7, The Macca Lodge/Nevele R Southland Oaks Final Mobile Pace (Gr2), an information was lodged A5995 by Stipendiary Steward, Mr C J Allison alleging that under rule 869(2)(a), Junior Horseman ,Mr R Todd (Strata Star) used his whip excessively inside the final 500 metres.
Facts:
Stipendiary Steward, Mr Allison showed the Committee several video clips of the alleged incident highlighting Mr Todd's use of the whip over the final 500 metres of the race.
Mr Allison believed Mr Todd had struck his horse 25 times from the 500 metre mark to the winning post.
Submissions for Decision:
Mr R Todd (Strata Star) disputed the allegations that he had struck the horse Strata Star on 25 occasions stating in his opinion he had struck it only 19 times.
Mr J Dunn in supporting Mr Todd stated that the race was the Southland Oaks Final and carried a high stake. In his opinion Mr Todd had driven his horse out to ensure he had every opportunity of gaining a dividend and stakes bearing place. Mr Dunn disputed also the fact that Mr Todd had used his whip excessively.
Reasons for Decision:
The Committee viewed the video clips on several more occasions and was clearly of the opinion that Mr Todd had struck his horse Strata Star on at least 25 occasions within the final; 500 metres of the race and because of this they are satisfied that the breach of the rule had occurred.
Submissions for Penalty:
Stipendiary Steward, Mr Allison stated that Mr Todd was a very successful Junior Horseman and that he had no previous breaches of this rule in the last 12 months.
Mr Todd asked the Committee to consider when fixing penalty to consider his driving record and that on this occasion he had driven the horse out with the knowledge that the race was of significant importance for the connections being of a high stake and a Group 2 race.
Reasons for Penalty:
The Committee considered the submissions as presented and gave Mr Todd some credit for his driving record over the past twelve months. The Committee also considered the breach to be mid range in the scale of excessive.
