After the running of Race 2 the Rheem, Peter Cocks for Dairy Cylinders Mobile Pace an Information A13960 was lodged by Stipendiary Steward Miss R Haley, alleging A Milne (Paradise Valley) used his whip free of the rein on several occasions in the run home.
Mr Milne admitted the charge and appeared at the hearing, and confirmed he understood the Rule.
The Rule reads:
No driver shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.
Miss Haley with the use of the videos stated that Mr Milne (Paradise Valley) after entering the home straight had used his whip on three occasions, free of the rein.
Submissions for Penalty:
Miss Haley said Mr Milne had had 5997 Lifetime Drives, 78 last season and 71 this season. Miss Haley added in her opinion the breach was at the low end of the scale, and Mr Milne had a very good driving record.
The JCA Penalty Guide recommends for a first offence, a fine of between $200 and $400.
Mr Milne stated he believed the breach was at the low end of the scale.
Reasons for Penalty:
After considering the submissions the Committee took into account Mr Milne's excellent driving record and admittance of the breach which is deemed at the low end of the range.
