Facts:
Following the running of Race 8, the Biofeed and Advance Agriculture and Country Jewel Handicap 65 2200 an Information was filed by Stipendiary Steward Mr M Davidson against Licensed Apprentice Jockey (Class B) Mr C Campbell, alleging that he angled his mount Asathought outwards when not sufficiently clear of Knutquacker, (K Mudhoo) which was checked near the 500 metre mark.
Mr Campbell was present at the hearing and he confirmed he understood the rule, and he indicated he admitted the breach.
He was assisted at the hearing by Apprentice Jockey Mentor Mr D M Walsh.
Rule 638 Provides as follows:
(1)-A rider shall not ride a horse in a manner which the Judicial Committee considers to be

Mr Davidson asked Chief Stipendiary Steward Mr J Oatham to show the video clips of the alleged incident. Mr Oatham highlighted the outward movement of Asathought, when he was not sufficiently clear of Knutquacker near the 500 metre mark.
Mr Oatham said that Knutquacker was not travelling particularly well, but Mr Campbell has come out too soon and checked Knutquacker.
Mr Campbell said he had simply made an error of judgement. His horse was travelling well and he had misjudged the room available.
Mr Walsh stated that Asathought was only having his seventh race day start and his first over a distance, and that he was racing keenly at the time of the incident.

Mr Davidson said that Mr Campbell had an excellent record, with one previous breach of this rule in the previous 12 months.
Mr Davidson believed that the incident was at the mid to low end of range of carelessness and was seeking a five national riding day suspension.
Mr Campbell accepted Mr Davidson’s summation. He stated that he had up to six or seven race day rides currently at most meetings.
Mr Walsh supported Mr Campbell, reinforcing his excellent riding record and the opportunities coming up with the Canterbury Jockey Club Premier 3 day meeting in November.
Reasons for Penalty:
The Committee agrees with Mr Davidson that the level of carelessness in this instance was at the mid to lower end.
For the purposes of fixing penalty, the low range penalty guide starting point is six national riding days.
Mr Campbell has been given credit for his excellent riding record, and his admission of the breach effectively reducing the penalty by 1 riding day.
