Decision:

As Ms Johnson admitted the breach it was found to be proved.

Penalty:

Ms Johnson’s Jockey’s License was suspended from the conclusion of racing on 23 February 2013 up to and including racing on 6 March 2013. The 6 days being:

25 February Auckland
27 February Hamilton
28 February Palmerston North
2 March Auckland (premier)
4 March Hamilton at Paeroa
6 March Auckland (premier)

When assessing quantum of penalty the committee was mindful that two of the days included were premier days, also no South Island days were included as Ms Johnson advised that she would not be riding at those meetings (Omakau and Cromwell).

Facts:

Information A1385 was filed by Co-Chief Stipendiary Steward Mr R Neal under Rule 638(1)(d). The information stated that (Ms Johnson) permitted her mount “Grande Bellezza” to shift inwards when not sufficiently clear crowding “Sadlers Rock”, “Our Zeby” and “Fazza” approaching the 1800m with Our Zeby being severely checked.

Ms Johnson acknowledged that she understood the rule and the charge preferred against her. She also confirmed that she admitted the breach.

Submissions for Decision:

Mr Oatham showed all available films, (head-on, side-on and rear-view) and identified the horses. Mr Oatham said that Ms Johnson allowed her mount to shift in crowding the inside runners, he said that she was four off the fence and after the interference would have been lucky to be two and a half off the fence. He said that when Mr Cameron’s mount was checked it clipped a heel and blundered and that Mr Bosson’s mount “Ballybit” was also affected. He added that there did not appear to be any pressure on Ms Johnson’s mount and that she came across of her own accord and that she failed to leave sufficient room for the runners to her inside. He said that the side-on film showed that Ms Johnson had her horse’s head turned out a touch but that the interference had occurred at that stage.

Ms Johnson said that she definitely got in for a couple of strides, but said that Jonathan Riddell used her at the same time to get his mount in but said he is entitled to do that if he wanted to.

Mr Neal said that the carelessness would be above mid-range. He said that she had a fair record, is a busy rider who had picked up a number of rides in the last six months. He added that on this occasion she had erred and let her mount shift in. He submitted that a suspension would be the appropriate penalty. He said that the starting point is one of 5 riding days suspension and that it was up to the committee to make the appropriate determination.

Ms Johnson said that she rides all over the country and that she had been unlucky in that she had got in for only a couple of strides. After considering the matter Ms Johnson said that she would like any suspension to commence after Matamata (premier) on 23 February 2013 and hopefully be back in for the second day of Auckland on 6 March 2013 (premier).

Reasons for Penalty:

The committee found that the carelessness was above mid-range and it took into account that three horses were affected with Our Zeby being severely checked. The committee believed that Ms Johnson’s record at best was only fair. It took into account the admission of the breach and the request for a deferment of commencement of any suspension imposed. Using the five day starting point the committee believed that under all the circumstances that a suspension of 7 days was warranted but reduced that by 1 day due to the admission of the breach.
