Following the running of Race 2, C & J McDermott & B & J Sandford Pace, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Graduation Horseman, Mr G C Telfer, alleging a breach of Rule 869 (2) (a) in that Mr Telfer, as the driver of SZYBKA BRAT in the race, “in the run home used his whip in an excessive manner”.
Rule 869 provides as follows:
(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.
Mr Telfer was present at the hearing of the information and he indicated that he admitted the breach.
Submissions for Decision:
Mrs Williams had Stipendiary Steward, Mr S Wallis, show a video replay of the final 300 metres of the race. He pointed out SZYBKA BRAT, driven by Mr Telfer, trailing the leader and then enter the passing lane. Just prior to the 200 metres, Mr Telfer commenced using the whip on SZYBKA BRAT and he continued to use it to the finishing line. Mrs Williams alleged that Mr Telfer had used his whip on 21 or 22 occasions in total. Mr Telfer told the Committee that he accepted the number of alleged strikes. The Committee noted that SZYBKA BRAT finished in 2nd placing in the race, beaten by a half-head.
Mr Telfer, when asked if he would like to say anything, said that he was “just trying to get to the line”.

Mrs Williams informed the Committee that Mr Telfer had a clear record under the Rule. She submitted that a fine of $200 was appropriate.
