The protest is upheld and PARAMOUNT DREAM is disqualified from the race.

Facts:

Following the running of race 2, Auckland Cup Week Starts 28 February 2yo Mobile Trot, an information Instigating a Protest was filed pursuant to Rule 870(3). The Informant, Mr Ydgren, alleged that PARAMOUNT DREAM galloped for in excess of 50 metres in the final 200 metres.

Mr Dickie was not present at the hearing and endorsed the Information “I do not contest the disqualification of PARAMOUNT DREAM”.

Judge’s placings were:

Rule 870(3) provides: "that any horse that breaks from its gait shall be promptly returned to its gait."

The Breaking Horse Regulations (part B) provides: "any horse which breaks from its gait in the final 200 metres of any race and continues on in a break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its gait."

The Regulation further provides: "where a protest has been duly lodged against the placing of an offending horse, The Judicial Committee shall either: (1) relegate such horse under Rule 870(4) to behind any other horse in respect of which an advantage may have been gained; or (2) disqualify it from the race under Rule 1003(2)."

Submissions for Decision:

Mr Ydgren demonstrated the incident using head and side on video films. He identified PARAMOUNT DREAM entering the final straight in 4th position and pointed out to the Committee that PARAMOUNT DREAM galloped for approximately 65 metres in the final 200 metres. He therefore sought the disqualification of PARAMOUNT DREAM in accordance with the Breaking Horse Regulations.

Reasons for Decision:

The Committee assessed the incident and are satisfied that PARAMOUNT DREAM broke for at least 65 metres in the final 200 metres and was therefore in breach of the Breaking Horses Regulations and Rule 870(3) in that she has failed to promptly regain her proper gait.
