Facts:
Following the running of Race 3 (Pak’nSave Clarence Street) Information No. A12937 was filed with the Judicial Committee. It was alleged by the Informant that Ms Newman allowed her mount to shift in when not clear of MOTUMAN which clipped a heel and stumbled near the 2000m.
Ms Newman in the presence of Mr Harris said that she understood the Rule, the Charge and confirmed that she admitted the breach.
Mr Robinson showed the film replays and identified the runners involved.
Mr Robinson said that Ms Newman had shifted in and then shifted out before any interference occurred. He said that Ms Newman then again shifted in when not clear of MOTUMAN which clipped a heel and blundered. He added that when Ms Newman realised what was happening she immediately pulled off. Mr Robinson estimated that Ms Newman’s mount was approximately ¾ length clear when shifting.
Ms Newman said that her mount had begun awkwardly and that her shift was an error of judgement. She said that she did initially straighten but then went back in onto MOTUMAN.
Mr Harris said that there was not any intent involved and that Ms Newman pulled off straight away.
Submissions for Penalty:
Mr Jones said that Ms Newman had not breached the Rule during the last 12 months and that it was a record to be proud of. He placed the carelessness in the mid-range.
Mr Harris reiterated that it was an error of judgement and that there was no intent.
Ms Newman said that she had four rides at Matamata on 9 September 2020.
Reasons for Penalty:
The Committee placed the carelessness in the mid-range category and adopted a starting point of 6 days Suspension. Taking into account Ms Newman’s excellent record and admitted breach, a discount of 2 days was afforded.
