Charge:
Following a trials meeting held at Counties on 19 July 2011, Miss S Spratt was charged with having in her possession a body protector which did not comply with the NZTR rules of racing.

Facts:
Mr Williamson explained to the committee that at the trials meeting at Counties on 19 July he noted Miss Spratt wearing a body protector which had the lower pads removed.

Submissions:
Mr Williamson submitted this clearly contravened the standards set by NZTR regarding the wearing of protective vests. Mr Williamson said he confiscated the vest from Miss Spratt upon discovering it did not comply with rule 610(4).

Miss Spratt, in admitting the breach, said she did not use this type of vest on race days as she always wore a Vipa vest. She said she was ignorant of the fact that she had to wear an approved vest at trials.

Submissions on Penalty:
Mr Williamson told the committee this was Miss Spratt’s first charge under this rule. He said she had admitted the breach and been fully cooperative with the stewards. He submitted a fine of $200 would be appropriate which was consistent with several other breaches of this rule recently.

Miss Spratt said she had been on holiday when other riders had been warned of the vest issues but was aware of her obligations under the rule. She had nothing to say regarding penalty.

Reasons for penalty:
The committee considered all the relevant facts and submissions as presented. In Miss Spratt’s favour are her admission of the breach and her clear record under this rule. However as explained to Miss Spratt the rule is there in the interest of safety for all riders and it is her obligation to be aware and comply with such rules. In this regard trial meetings are no different from race meetings.

Penalty:
Accordingly we impose a fine of $200.
