Facts:
Mr C Studd admitted a breach of rule 638 1 (d) in that, he allowed his mount LONDON BRIDGE, to shift inwards passing the 1400 metre mark when not clear of BETTYS BOY (L Whelan) which was checked.
Mr Neal (Stipendiary Steward), using the available films pointed out the incident on the bend at the 1400 metre mark. He submitted that Mr Studd who was travelling on the outside of Miss Whelan’s mount, moved inwards when not the required distance clear, causing a check to BETTYS BOY.
Mr Studd submitted that he thought he was sufficiently clear when moving inwards. He felt Miss Whelon was trying to hold her position to which he admitted she was entitled to do. He confirmed that Miss Whelan did call, and that his actions were not intentional.
Submissions for Penalty:
Mr Neal submitted this was Mr Studd's first charge under this rule since his arrival in New Zealand two months ago. He believed in twelve years of riding he has only been charged once. Mr Neal submitted the accident could be classed in the below mid range and asked for a period of suspension of three days.
Mr Studd confirmed Mr Neal's comments on his riding record and informed the committee that he had commitments this coming Saturday, and that he is a high weight and jumps rider domiciled in Hastings.

Mr Studd in coming to our decision to impose a period of suspension for this breach, we have taken into account your very good record and your admittance of the breach.
Mr Neal in his submissions believed the breach to be in the below mid range we however, after revisiting the films of the incident, believe it to be more severe. Miss Whelan did suffer quite a nasty check when you moved inwards causing her to hold.
