As Mrs Allpress admitted the breach the Committee find the charge proved.

Penalty:

The Committee grant Mrs Allpress' request to seek a deferment to her suspension as per Rule 1106(2).

Accordingly, Mrs Allpress had her license to ride in races suspended for a period to commence after racing on 14 May and conclude after racing on 20 May 2016 (4 days).

Facts:

Following the running of race 4, Bains Liquid Disposal 1400, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Jones, alleged that Mrs Allpress permitted her mount KITTYKITTYBANGBANG to shift outwards when not sufficiently clear of LIBRETTI which was checked near the 1000 metres.

Mrs Allpress acknowledged that she understood the Rule and confirmed her admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Oatham demonstrated the incident on the available video footage. He identified that near the 1000 metres Mrs Allpress was crossed by JANE’S SECRET. He said Mrs Allpress then immediately came across that runner's heels when not the required distance clear which forced Mr Colgan to check his mount. He added that Mrs Allpress should have made more of an effort to stay where she was.

Mrs Allpress freely admitted that she made an error of judgement and advised the Committee that she should have taken a firmer hold of her mount.

Submissions for Penalty:

Mr Jones produced Mrs Allpress' record which showed 3 previous breaches under this Rule in the last 12 months, the most recent being 19 March which incurred a 5 day suspension and in addition a $1200 fine. He described the level of carelessness as low to mid – range and stated Mrs Allpress' record was relatively good for a busy rider. He said Mrs Allpress should be given credit for her admission of the breach. Mr Jones submitted a suspension of not less than 4 days would be appropriate.

Mr Jones provided several recent examples of Mrs Allpress riding in the South Island on Industry days. He said the Stewards deemed Mrs Allpress to be a National rider.

Mrs Allpress advised that she had upcoming engagements at New Plymouth on 14 May, and sought a deferment to any proposed suspension. Mrs Allpress informed the Committee that she was riding at Ashburton on 13 May which is an Industry day. She stated that it was her intention to ride all over the country in the near future to retain her lead in the Jockey’s premiership.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. The Committee have adopted 5 riding days as the starting point in considering the term of suspension for this careless riding charge. The mitigating factors were Mrs Allpress' admission of the breach and her good record in relation to this Rule for which she has been given credit. However, this has to be balanced against the consequences of Mrs Allpress' actions which resulted in Mr Colgan being checked. We assess the level of carelessness to be in the low to mid – range.

The Committee was satisfied that Mrs Allpress has a recent history of riding all over the country on Industry days.

After taking into account all the above factors the Committee considers an appropriate suspension was 4 days.
