Facts:

Stewards lodged a protest against the fifth placed SPRINGBANK MASON alleging a breach of r 870 (3) and the Breaking Horse Regulations in Race 3. They sought the disqualification of SPRINGBANK MASON from its fifth placing under r 1003 (2).

Submissions for Decision:

Mr Munro stated, with the aid of the video, that SPRINGBANK MASON was in a challenging position when it broke from its gait approximately 90 metres from the finish. It continued on in a break until the finish line, finishing in fifth placing. He said Mr M Williamson made every attempt to restrain the horse and return it to its proper gait. He sought disqualification of SPRINGBANK MASON under r 1003 (2). The connections of SPRINGBANK MASON did not contest the protest.

Reasons for Decision:

After viewing the films and hearing the evidence of the Stewards the committee is satisfied SPRINGBANK MASON was in breach of both the Breaking Horse Regulations and r 870 (3). The protest is upheld.
