The Protest is therefore upheld and the horse GEORGE is disqualified from the race.

The placings will now become:

1st - FRANCO NADAL

2nd - NATURAL

3rd - SPEEDY EARL

4th - LARCH

5th - SPECIAL FLIGHT

Authorisation is given to pay dividends and stakemoney accordingly.

Facts:

Following the running of race 10, the IGNITE ARCHITECTS HANDICAP TROT 2700, an Information was lodged by Mr Mulcay, instigating a protest against the 4th placed horse GEORGE. He alleged that GEORGE had broken in excess of 50 metres inside the final 200 metres.

Mr Macfarlane, trainer of GEORGE was not present at the hearing, however he indicated that he admitted the breach of the Rule by noting on the Information that he did not contest the protest and duly signing his name.

Rule 870(3) requires ' any horse which breaks from its gait shall promptly regain its proper gait'.

The Breaking Horse Regulations provide 'that any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait'.

Submissions for Decision:

Using the available films Mr Mulcay demonstrated that GEORGE had gone into a gallop as it approached the 150 metres mark in the final straight. The horse continued on in a gallop until it passed the finishing post in 4th position. Mr Mulcay therefore stated that the horse was in breach of the Rule and Regulations stated above and submitted that the Committee should disqualify GEORGE from the race.

Reasons for Decision:

 Since this protest was not contested by the horse's connections the Committee upheld it.
