As the respondent has admitted the breach, we find the breach proved.
Penalty:
Mr Chan is suspended from riding at end of the meeting at Timaru on 22 July up to and including Egmont on 4 August. This is 2 days.
Facts:
Mr Davidson alleged that Mr Chan allowed his mount BORN A ROYAL to shift outwards when not sufficiently clear of HABITUDE (M Chui) which was checked passing the 850 metres.
Mr McLaughlin, Stipendiary Steward, demonstrated that the respondent was racing mid-field near the rail when he shifted out. Mr Chui, who was racing 3 wide with 2 horses to his inside, had to take hold and check his mount.
Mr Chan said he had no comment to make on the videos.
Mr Harnett pointed out that there had been bumping between the 2 horses in front of the respondent and this had led to his deciding to come out. He said the horse over-reacted and this accentuated Mr Chan’s movement. He had come out more than he intended.
Submissions for Penalty:
Mr Davidson produced the respondent’s record, which was clear under this Rule. He said the respondent was a South Island jockey and the 3-day starting point in the Penalty Guide should be adopted. He believed 2 days was the appropriate penalty.
Mr Chan asked that the penalty be deferred as he had riding commitments at Timaru. Mr Davidson did not object to this.
Reasons for Penalty:
We regard the breach as towards the lower end of the scale of careless riding. We accept that the respondent’s decision to come out was initiated by his decision to get away from the bumping that was occurring in front of him. However, Mr Chui has had to check his mount quite severely. Mr Chan was clearly not his length and another clear, as he now accepts. We adopt the 3-day starting point.
Personal mitigating factors are the respondent’s excellent record (132 rides and no breach of the Rules) and his ready admission of the breach.
Mr Chan explained that he was transferring to the Central District stable of Mr Sharrock at the start of the coming season. Mr Davidson stated that in his view it was appropriate for Central District days to be taken into account when considering days next season.
