Mr Johnson had admitted the breach and the charge was found proved. 

Penalty:

Mr Johnson’s Senior Jockey’s Licence was suspended from the conclusion of racing on 23rd August 2013 until the conclusion of racing on the 28th August 2013, incorporating three national dates. 

Charge:

Following the running of Race 5, the GLENORA FARMS LTD MAIDEN an information was filed by Stipendiary Steward Mr M Davidson, against Licensed Senior Jockey Mr C Johnson, alleging a breach of Rule 638 (1) (d) in that... passing the 350m C Johnson (Karaka Jack) allowed his mount to shift outwards dictating and crowding Luvlybubbly (J Morris) Just Bolting (R Doherty) and Leeboy (T Moseley).

Mr Johnson was present at the hearing and indicated that he admitted the breach.   

Facts:

Stipendiary Steward, Mr J McLaughlin, with the assistance of the Race Video, illustrated how Mr Johnson’s mount Karaka Jack was near the rear of the field and three off the rail approaching the home straight. He indicated that near the 350m mark Mr Johnson shifted outwards coming into contact with Luvlybubbly. The interference resulted in Luvlybubbly shifting outwards crowding Just Bolting and Leeboy.

Mr Davidson stated that Luvlybubbly overreacted when coming into contact with Karaka Jack. However the interference to the other two runners was severe. He accepted that when Mr Johnson improved his position his line was dictated by a leading runner, Prince Eden (R Bishop) which had drifted outwards taking his line. However, Mr Johnson had continued on with his run and had allowed his mount to contact Luvlybubbly.

Mr Johnson stated he thought he was going to get a clear run. When he started his run the horse ahead of him had drifted outwards forcing him outwards onto Luvlybubbly. He felt he had only brushed Luvlybubbly when improving. However, he admitted that the field was bunched at that point outside his mount.  

Submissions for Penalty:

Mr Davidson told the committee that Mr Johnson had one previous breach of this rule in December 2012, during the past 12 months. He was a senior national jockey and in that time he had ridden approx. 483 times. The interference was at the low to mid range. He said there were mitigating factors and was seeking a suspension of four national days.

Mr Johnson asked that the mitigating factors be taken into account. He felt four days was high considering his good record and the level of interference was low to mid range. He was seeking a seven day deferment of any suspension. 

Reasons for Penalty:

The committee believed a starting point of five days suspension was appropriate. Mr Johnson was given credit for his early admission of the breach and also his outstanding riding record over the past 12 months as a senior jockey. The committee noted there were mitigating factors involved in the incident, namely that Mr Johnson was riding in tight quarters when his mount was shifted outwards. Mr Johnson requested a deferment of any suspension for seven days. 

The committee believes a suspension of three national days is appropriate. The suspension is to start at the completion of racing on Friday 23rd August.
