Facts:
Mr Williamson said Mr Johnston was acting in a caretaker role for Trainers G and D Rogerson. When saddling JUSTINE’S PRIDE and LADY LOVE he transposed the two saddle cloths. The mistake was detected at the time the horses were having their plates inspected. The mistake was rectified before the horses were brought into the birdcage.
Mr Johnston agreed with the facts as stated by Mr Williamson.
All other gear on both horses had been properly applied.

Mr Williamson said Mr Johnston had no breaches of the rules recorded against him. The offending was mid range. He referred to two other penalties imposed for a breach of this rule. One penalty was a fine of $150 and the other a fine of $300. He submitted that a fine consistent with those penalties be imposed.
Mr Johnston accepted the submission of Mr Williamson. He said this was the first mistake of this kind he had made in a period of 2 years that he had been working for the trainers. He apologised for the mistake.
