Facts:
At the conclusion of Race 4, the Gold Ace By Bettors Delight 4Yr & Older Provincial Drivers Mobile Pace, an Information 13725 instigating a Protest was lodged by Mr Allison, (Stipendiary Steward) under rule 870(5) alleging that with 20 metres to run Shard Ark (G O’Reilly) broke from its gait and was lapped on by Rennie Sivad and Sheeza Duchess.
The rule 870(5) Reads: When any horse breaks from its gait in any race its horseman shall immediately take all reasonable steps to return it to its proper gait and where clearance exists immediately take such horse clear of the field. (5) Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finish line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869(8) such relegation of the horse shall be at the discretion of the Judicial Committee.
Stipendiary Steward Mr S Renault showed the Committee a video clip of the horses racing over the concluding stages of the race, pointing out where Shard Ark had galloped approximately 20 metres from the line and continued to do so until past the finish line.

Mr Renault also demonstrated, using the video film, that Shard Ark had been ‘lapped on’ by two other runners, namely Rennie Sivad and Shezza Duchess.
Mr Kilkelly, Owner/Trainer of Shard Ark accepted this as a true account of the incident.
Reasons for Decision:
After taking into account all the evidence presented, the Committee was satisfied that Shared Ark (G O’Reilly) broke from its gait and was lapped on by Rennie Sivad and Sheeza Duchess.
