Decision:

As the breach was admitted we find the charge proved.

Penalty:

After taking all the above into account the committee determines the appropriate penalty to be one of six days.  Accordingly we suspend Miss Holmquist from after the conclusion of racing on 25 June until after racing on 5 July 2014 (6 North Island days).

Within minutes of leaving the room and before the committee and stewards had left, Mr Somervell returned.  He asked the committee if Miss Holmquist could start her suspension following racing at Rotorua on 23 June.  The declaration of riders had not closed for Te Teko and at this stage she only had one ride and that was on one of his own horses.  He was happy to release her from this ride.  After further questioning from Mr Coles and the committee and as declarations had not closed for Te Teko, the committee was satisfied that no other connections were affected.  Therefore Mr Somervell's request was granted and Miss Holmquist's suspension now starts after racing on 23 June and concludes after racing on 3 July (6 North Island days).

Facts:

Following Race 9, the Totara Vineyard Sherries and Ports 1580, an information was lodged pursuant to rule 638 (1) (d).  Mr A Coles alleged that Miss Holmquist allowed her mount HOLY AFFAIR to shift ground outwards into SUPER THUNDER (R Norvall), ALL ABOUT FUN (P Turner) and RAF LANAC (B Grylls) with all those runners being crowded and checked at the 250 metres.

Rule 638 (1) (d) reads as follows:  a rider shall not ride a horse in a manner which the judicial committee considers to be careless.

Submissions for Decision:

Mr Davidson demonstrated the video films pointing out HOLY AFFAIR racing in a position one off the rail just after the final turn in the home straight. On his outside was SUPER THUNDER, ALL ABOUT FUN and RAF LANAC. Mr Davidson told the committee that soon after this point Miss Holmquist allowed her mount to shift outwards and into the line of SUPER THUNDER when insufficiently clear. He said this caused severe crowding and buffeting to SUPER THUNDER and the 4 runners on its outside. EL CORBY (L Satherley) which was racing on the extreme outside received quite a severe bump from RAF LANAC as a result of that runner being forced out.

In answer to a question from the committee as to whether Mrs Satherley had contributed to the interference by moving in Mr Davidson said he believed Mrs Satherley had kept a straight line.

Neither Mr Somervell nor Miss Holmquist had any questions of Mr Davidson when asked.

Miss Holmquist said her mount had been hanging out and she was trying to correct him when he started his outward movement. She also submitted that Mrs Satherley had contributed to the incident by applying pressure from the outside when moving in slightly. Miss Holmquist stated she was half a length clear when moving out.

Mr Somervell, in support of Miss Holmquist, also said Mrs Satherley had contributed to the incident by moving in. He submitted that Miss Holmquist had only 25 race day rides and was still learning but believed there were mitigating circumstances surrounding the charge.

Mr Coles said that approaching the 350 metres Miss Holmquist was two off the rail. He said that the films clearly showed that she then continued on an outward movement to be five off the rail when the interference occurred. He conceded Mrs Satherley does appear to lay in but this was as a result of receiving contact from the inside. However he added that this in turn caused Miss Holmquist to become unbalanced on her mount. Mr Coles concluded this part of his submission by saying Miss Holmquist was not the required distance clear when moving out.

Submissions for Penalty:

Mr Coles produced Miss Holmquist's record which showed one suspension of five days in her 25 rides to date.  Mr Coles stated she was still relatively inexperienced and had admitted the breach.  However he said three runners had received severe interference and submitted Miss Holmquist's level of carelessness was in the mid to high range.  He concluded that a suspension of 5 to 7 days would be appropriate.

Miss Holmquist said she had rides until after racing on 25 June at Te Teko and she only rode throughout the North Island.

Mr Somervell confirmed Miss Holmquist's submissions.

Reasons for Penalty:

The committee carefully considered all the submissions and evidence as presented. In assessing penalty the committee has adopted five riding days as a starting point. Mitigating factors are Miss Holmquist's admission of the breach, her good record to date and her inexperience.  However in aggravation Miss Holmquist has caused severe interference to three horses moving out when insufficiently clear.  She made the mistake of continuing to ride forward without taking measures to correct her mount.  Clearly she was not the required distance clear when moving out.  The committee considers her level of carelessness to be mid range.
