I thus declare CHAIR UP to be a non-starter.

Facts:

Mr McLaughlin, stipendiary steward, alleged that the barrier for CHAIR UP (Mr Bates) was slow to open thus denying that runner a fair start in race 5, the L.J. HOOKER GROUP MILE.

Rule 632 provides:
If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter.

Submissions for Decision:

Mr Zarb, stipendiary steward, demonstrated on the video angles that the barrier second from the outside, which was occupied by CHAIR UP, was slow to open. As a consequence, CHAIR UP was slow away and settled at the rear of the field.

Mr Bates stated that CHAIR UP had had to force her way out of the stalls. He said the gate was definitely slow to open. It had not been his intention to settle CHAIR UP at the rear of the field.

Ms Clark, the official starter, said she was not aware at the time that that the gate had been slow to open but shortly after the start, the assistant who had been holding CHAIR UP, had said to her that the gate was late to open. On viewing the videos, she could now see that it was.

The horse finsihed in eighth place.

Reasons for Decision:

I am satisfied that CHAIR UP was denied a fair start due to the slowness of her gate to open. She has settled in last position in the field as a consequence. This was not through any fault on her part. In fact, she has had to push her way out of the stalls.
