Decision:

Facts:

Following the running of Race 8, the BOOK YOUR CUP DAY FUNCTION NOW MOBILE PACE, Mr Allison, Stipendiary Steward, alleged that Mr K Larsen (Xtreme Luck) shifted ground outwards with approximately 1350m to run forcing M J Williamson (White Socks) to race wider on the track.

Rule 869 provides as follows:
6 (b) a horse making a forward movement during any race shall not be forced to race wider on the track.
(c) a horse during a race shall not move ground outwards once the nose of the wider runner coming forward is in line with or past its sulky wheel and until the wider runner going forward is fully past.

Submissions for Decision:

Mr Allison showed the Committee video replay of the relevant part of the race. He pointed out the field racing at approximately the 1350m mark. Mr Larsen (Xtreme Luck) was travelling in the one back and one out position. Mr M Williamson (White Socks) was trailing that horse. Mr Allison used video to demonstrate where Mr M Williamson had begun a passing movement by moving outside Mr Larsen. Mr Allison alleged that Mr Larsen then moved his horse outwards whilst the nose of Mr M Williamson's horse (White Socks) was at (or past) the sulky wheel of Mr Willimson's horse. Mr Allison showed where this action of Mr Larsen forced Mr Williamson to then race four wide for a period, thereby covering considerable extra ground. Mr Allison also asked Mr M Williamson that this in fact did happen and that neither Mr Williamson or his horse had contributed to the incident.

Mr Williamson stated that he was indeed pushed wider on the track and that at the time when Mr Larsen pushed out , Mr Williamson’s horse (White Socks) did indeed have its nose at or past the sulky of Mr Larsen.

Mr Larsen agreed that his horse did cause the outward movement of (White Socks) driven by Mr M Williamson but that his intention to do so was thwarted by his horse hanging badly, causing it to take a little longer to move outwards, thereby allowing Mr Williamson’s horse (White Socks) to move more forward than he expected.

Mr Allison confirmed to the Committee that the horse did hang badly and that it had a history of hanging.

Mr Williamson confirmed to the Committee that if had not taken hold of his horse, he may have hit Xtreme Luck, driven by Mr Larsen.

Mr Larsen concluded by stating that his actions only caused Mr Williamson to cover extra ground for a short distance, and that he was attempting to give his horse every opportunity.

Mr N Williamson stated that it was clear that Mr M Williamson was forced over extra ground, but was unsure whether it had it chances affected.

Reasons for Decision:

The Committee carefully considered all the evidence given by all parties, paying particular attention to the relevant video evidence.

Submissions for Penalty:

Mr Allison produced the defendant’s record which showed no previous breaches under this rule. In fact there had been no breaches under this rule for the past seven years. Mr Allison stated that he had some sympathy for Mr Larsen because the horse could be difficult to drive, however Mr Larsen knew the horse and still made a minor error of judgement. He submitted that a fine at the lower end of the scale was appropriate.

Reasons for Penalty:

In determining penalty the Committee took into account Mr Larsen’s excellent driving record and Mr Allison’s comments regarding the racing manners of the horse.
