Decision:

The Committee ruled that the horse ‘Madam Swiss’ had been prevented from taking an effective part in the race due to the lead rope being attached. It was ordered that she be declared a non-runner.

It was further ordered that dividends and stakes for the race be amended accordingly.

The Committee recommends the NZTR make an ex gratia payment to the connections of ‘Madam Swiss’.

Facts:

Following the running of Race 3, the NZB Insurance Pearl Series Race, an Information was filed by Stipendiary Steward, Mr M Davidson, requesting a Ruling under Rule 632(1). The Information stated that Madam Swiss (L Callaway) raced with a lead rope attached.

Rule 632 provides as follows:

If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter.

Submissions for Decision:

Mr Davidson showed the video of race 3, an 800m event for two year olds. He pointed out ‘Madam Swiss’, who finished fifth, starting from barrier one and indicated how she had travelled the entire race with a lead rope attached. He said the film clearly showed an attendant standing up in the starting stalls with ‘Madam Swiss’ and in his hand a curled-up lead rope. As the race jumped the lead rope somehow became entangled in Mr Callaway’s leg and remains there throughout.

The Starter, Mr Leigh-Ogden explained the sequence of events leading up to the start were normal and it was just a freakish thing that occurred.

Mr Callaway was asked when he had noticed the lead rope and he said a few strides after the start. The Committee then asked if the lead rope affected his horse’s chances and if it had altered the way he rode the race. He said it definitely affected both.

Mr T Mills- Chief Executive Officer asked the committee for a ruling concerning the stake for 5th. placing ($500) being paid to the connections of ‘Madame Swiss’.

Reasons for Decision:

The Committee was satisfied that ‘Madam Swiss’ chances were diminished by the lead rope being attached throughout the entire race.
