Facts:
Following the running of Race 2 (Bruce Clifton Builder/Summer Electrical Maiden (1200m) Information No.A9209 was filed with the Judicial Committee. It was alleged by Mr Parkes that the first-placed horse RUFUS RUFFCUT interfered with the chances of the second-placed horse VINCENT in the final straight.
Rule 642(1) provides:
“If a placed horse or its rider causes interference within the meaning of this Rule 642 to another placed horse, and the judicial committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.
Judge’s Placings were:
1st - RUFUS RUFFCUT
2nd - VINCENT
3rd - SARDEEN
4rh - MOLIZLAD
The Official Margin between 1st and 2nd was one length.

All film replays were shown to all persons present with Mr Whiterod identifying the horses RUFUS RUFFCUT and VINCENT with their riders confirming same.
Mr Parkes said that near the 100m mark when his mount VINCENT led the field narrowly and was responding well to his urgings, while RUFUS RUFFCUT was on his outside challenging and it drifted in when challenging and bumped VINCENT twice before being eased back onto its own line of running. He said his horse was unbalanced for a time and recovered to finish the race off well. He said he had been racing about four horses off the inside rail at the time of the interference and finished up just one off after. Mr Parkes said VINCENT had clearly been affected and had not got the clear run it was entitled to and lost momentum in the incident.
Mr Bolton submitted the interference had completely knocked VINCENT off stride at a vital time forcing Mr Parkes to steady his mount before re-gaining forward momentum. He said by that time RUFUS RUFFCUT had gained a length or more on VINCENT who kicked on well to the line.
Mrs Allpress said RUFUS RUFFCUT, who was racing greenly, had come from behind VINCENT to get up alongside when her horse laid in for two strides and “touched” that runner “once or maybe twice” before she immediately straightened her horse which then “ran away” from Vincent to win. “My horse won on his merits and I feel it would be unjust to change the placings,” Mrs Allpress said.
Mr Lennox said the winning margin of a clear length was a decisive factor. “My horse has come from behind and run away from VINCENT and in my opinion the there is no way it was going to be beaten.”
Reasons for Decision:
The Committee found that near the 100m mark RUFUS RUFFCUT shifted out and bumped VINCENT twice, however, over the final 90 metres was not taking any ground off RUFUS RUFFCUT. The committee observed Mr Parkes only very briefly had to stop riding his mount out following the skirmish and therefore the committee was not satisfied that had such interference not occurred that would have finished in advance of RUFUS RUFFCUT.
