As Mr Larsen has admitted the breach we find the breach proved.

Mr Larsen is fined the sum of $300.

Facts:

Mr Renault alleged that Mr Larsen used his whip excessively in race 5 in the home straight.

Mr Renault demonstrated on the video that Mr Larsen, driving ARTHUR LOWE, struck his horse 21 times in the run home. He pointed out the horse was given no respite.

Mr Larsen stated that he had struck trouble as the field turned for home and his horse had galloped for a stride. He said he was “late getting going” and ARTHUR LOWE was running into the finish and was responding to his urgings. He had simply used the whip too many times.

Submissions for Penalty:

Mr Renault produced the respondent’s record under this rule, which was clear for the past 12 months. Mr Larsen had had 112 drives last season and 86 this season.

Mr Larsen emphasised his clear record and that he had simply miscounted.

Reasons for Penalty:

The starting point is a fine of $500. We accept ARTHUR LOWE had galloped for a stride on the bend into the straight and thus Mr Larsen had started his run later than he had intended. However, there were 21 strikes and we note there was no pause, at all.

There is no uplift in the starting point as the breach is towards the lower end of the scale. Mr Larsen has an excellent record and has admitted the breach. We give a $200 discount for these factors.
