In terms of the Rule and in exercising its discretion, the Committee declared both COLORADO BAY and ST REGIS to be starters.

Facts:

Following the running of Race 8 (SEATON PARK SUPPORTING LIFE EDUCTION TRUST), Information No. A7326 was filed with the Judicial Committee. The Informant requested a ruling as to whether COLORADO BAY and ST REGIS were denied a fair start.

Rule 632 provides:
If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord) the Committee may declare such horse to be a non-starter.

Submissions for Decision:

Mr Goodwin identified both horses on the film replays and said that the Assistant Starter was up with the horses (in the stalls) and that the question for the Committee was did he have any involvement with the horses being slow away? After viewing the films several times Mr Goodwin said that it was clear that the starting stalls functioned correctly.

Ms Cowan said that her horse COLORADO BAY had been fractious in the barrier but she was not sure if it was being held when the gates opened. She said that it was odd that her horse and the other horse (ST REGIS) had issues.

Ms Morgan said that her horse (ST REGIS) had been playing up and that prior to the start had been held by the Barrier Assistant. As ST REGIS jumped it got stuck on the side (of the stall). She said that she was not sure if it was still being held (as the start was made). She added that it just kind of shied away from the other horse.

Ms Northcott did not make any comment.

Mr Clement the Starter, said that when he pushed the button it (ST REGIS) went up (reared). He said that he was not sure if either horse was being held.

Mr Firth the Barrier Assistant, who had been up in the stalls attending to both horses, said that they were not being held and that it was bad timing when it (ST REGIS) went up (reared) as the start was made. He added that he had been rubbing and patting the horses necks and heads.

In answer to a question from the Committee, Mr Jones said that neither horse was being held and that ST REGIS reared and turned its head inwards as the start was made.

Reasons for Decision:

The Committee was satisfied that the barrier stalls functioned correctly and that neither COLORADO BAY nor ST REGIS was being held when the start was effected. It was clear that COLORADO BAY was slow away of its own accord. Insofar as ST REGIS was concerned, the only question was had it reared and turned its head to the left of the front gates prior to or when the start was made.

After considering all of the evidence and in particular that of the Barrier Assistant, Mr Firth who was up attending to the horses when the start was effected, the Committee determined that the rearing and turning of the head by ST REGIS was as the start was made and that ST REGIS was the author of its own misfortune.
