As Ms Thornton admitted the breach we find the charge proved.
Penalty:
We grant Ms Thornton's request to seek a deferment to her suspension as per Rule 1106(2).
Accordingly, we impose a suspension on Ms Thornton which will commence after racing on 18th of December and conclude after racing on 27th of December 2013 (5 North Island days).
The penalty did not include any South Island meetings as Ms Thornton confirmed that she did not intend riding there.
Facts:
Following the running of Race 5, SHAW’S WIRE ROPES SPRINT, an Information was filed pursuant to Rule 638(1) (d). The Informant, Mr Oatham, alleged that Ms Thornton permitted her mount HARVEST to shift inwards when not sufficiently clear crowding AMETSIS which was checked approaching the 100 metres.
Ms Thornton acknowledged that she understood the nature of the charge, the Rule and confirmed her admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Williamson identified on the films near the 100 metre mark Ms Thornton was racing 5 off the running rail and directly to her inside was AMETSIS. He said when Ms Thornton placed HARVEST under pressure her mount shifted in to a point where AMETSIS runs out of room. He added AMETSIS was approximately ¾ of a length inside HARVEST.
Ms Thornton informed the Committee that she was not aware AMETSIS was racing on her inside and her mount was tiring when it shifted in.

Mr Oatham produced Ms Thornton’s record which showed 4 previous breaches under this Rule in the last 12 months. He described Ms Thornton's record as reasonable noting that 2 of her previous breaches occurred 11 months ago. He assessed the level of carelessness as relatively low but noted the status of the race (Listed $50,000) was an aggravating factor. He submitted a penalty of 5 to 6 days would be appropriate.
Mr Oatham informed us AMETSIS finished in 6th place and her chances of gaining valuable black type may have been affected.
Ms Thornton advised that she had upcoming commitments at Matamata on 18 December, and that any period of suspension could commence after that.
Ms Thornton confirmed that she rode only in the North Island and submitted a 4 day suspension would be adequate.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating factors are Ms Thornton’s admission of the breach and the level of carelessness is assessed as low range. The aggravating factors are this is Ms Thornton’s 5th breach under this Rule in the last 12 months and the breach occurred in a listed race carrying a stake of $50,000.
After taking into account all the above factors we consider an appropriate penalty is a 5 day suspension.
