Therefore the protest is upheld and the horse STAR MONARCH is relegated to third position behind the horses which were 'lapped on' at the finishing line.
The amended placings are accordingly:

5th - LE LUA INVASION
Facts:
Following the running of Race 9, the KONICA MINOLTA HANDICAP TROT, a protest was lodged against the horse STAR MONARCH, alleging a breach of Rule 870(5) in that STAR MONARCH, placed first by the Judge was in an incorrect gait when it's nose reached the finishing line and was 'lapped on' by JIMBO JOHNSON horse 12 and IT'S BIG TIME horse 8.
The Judge's placings and margins were :
1st - STAR MONARCH
2nd - JIMBO JOHNSON, short head
3rd - IT'S BIG TIME, neck
4th - IVANOV, long neck
5th - LE LUA INVASION, 1.4 lengths
Submissions for Decision:
The incident was demonstrated on the available video film by Mr Muirhead and his evidence was supported by a copy of the photo finish.
The video film clearly showed that STAR MONARCH was trotting and leading the field as it approached the finishing line when it went off stride and galloped approximately two strides short of the line. At the time STAR MONARCH was clearly 'lapped on' by JIMBO JOHNSON and IT'S BIG TIME.
Mr R Douglas, the trainer of STAR MONARCH conceded that he did not wish to contest the protest.
