As Ms Gerard admitted the breach the Committee found the charge proved.

Ms Gerard was fined the sum of $150.

Facts:

Prior to the running of race 1, an Information was filed pursuant to Rule 537(a). The Informant, Mr Oatham, alleged that Mr M Moroney & Ms P Gerard failed to declare riders for POWERS THAT BE (race 1) and THE BOY WONDER (race 3) by the required time.

Rule 537(a) provides: The Trainer or Owner or lessee (as the case may be) or the Agent of the Trainer or Owner or lessee (as the case may be) for a horse accepted or deemed to have been accepted for a Race shall:

(a) declare to NZTR the name of the Rider of that horse by the time and date specified by NZTR for declaration of Riders for that Race;

Ms Gerard endorsed the Information that she admitted the breach and did not wish to be present at the hearing.

Mr Oatham confirmed the contents of the Information and stated that a charge of this nature would normally be dealt with under the Minor Infringement System. However, as this was Ms Gerard 3rd breach within the 120 day reset period the Stewards were obliged to file an Information.

Submissions for Penalty:

Mr Oatham submitted a fine in the vicinity of $100 to $200 would be appropriate. The Stewards advised Ms Gerard of their proposed submission. On that basis she accepted the proposed penalty and elected not to appear in person.

Reasons for Penalty:

The Committee considered all the evidence and submissions presented.

Pursuant to the Minor Infringement Penalty Table we applied a modest uplift given that this is the 3rd breach within the last 120 days for the training partnership.
