Mr Ydgren, Chief Stipendiary Steward, alleged that Mr Lee exceeded the permitted number of strikes when driving MYRCELLA inside the final 400 metres of race 4 the NET TEN EOM FRESH AT MACCA LODGE MOBILE PACE.
Mr Munro, Stipendiary Steward demonstrated on the videos that the respondent used his whip 13 times in the last 400 metres.
Mr Lee has signed the information stating he admits the breach and does not wish to be present.

Mr Ydgren produced the respondent’s record which evidenced one breach of this rule on 11 November last. He has had 7 drives this season and 4 last season. The starting point for a second breach is 3 to 5 days’ suspension. Mr Ydgren tells us that Mr Lee was told that the Stewards would submit that a penalty of a 3 days suspension was appropriate. We were further told that he has accepted that 13 is the number of strikes.
