Facts:
Following the running of race 7, Les Harrison Distribution Handicap Trot, an Information Instigating a Protest was filed pursuant to Rule 870(5). The Informant, Stipendiary Steward, Mr Muirhead alleged that 1st placed YALDY BOYZ broke (1 stride before the finish line) and was lapped on by 2nd placed SILVER STREAM. The official margin was a nose.
Ms Milina the Trainer of YALDY BOYZ was present at the hearing and she advised the Committee that the Protest was contested.
Judge’s placings were:
1st - No 5. YALDY BOYZ
2nd - No. 13 SILVER STREAM
3rd - No. 7 GINTARAS
4th - No.4 BURT MUNRO
Rule 870(5) provides: Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869A such relegation of the horse shall be at the discretion of the Judicial Committee.
Lapped on: Lapped On means when a horse has its nose in line with any part of the breaking horse’s body when the nose of the breaking horse reaches the finish line.
Submissions for Decision:
Mr Muirhead demonstrated the incident using the available video footage. He said that YALDY BOYZ was trotting roughly short of the finish line and in his opinion the horse’s action changes 1 stride before the finish. He believed that YALDY BOYZ was not in its correct gait at the finish and it was lapped on by SILVER STREAM.
Ms Milina submitted that although her horse was trotting roughly she was of the view that at the finish line YALDY BOYZ front legs were in a trotting motion.
Mr Abernethy acknowledged that YALDY BOYZ was trotting roughly over the concluding stages but disputed that his horse was in a break when it hit the line. Mr Abernethy used the race films to demonstrate his point and he emphasised to the Committee that the films showed his horse's leg action confirmed that it was in its correct gait at the finish. He believed that YALDY BOYZ galloped after the finish line.
Reasons for Decision:
The Committee carefully considered all of the submissions presented and reviewed the video footage numerous times. We were able to slow the films down to ¼ speed and pause the film on the finish line given the close proximity of the alleged incident. We established that over the concluding stages YALDY BOYZ was trotting roughly but maintaining its correct gait. In our opinion the available films showed that when YALDY BOYZ nose reached the finish line he was in his correct gait and this was supported by the horse’s leg action at that point.
We were satisfied that YALDY BOYZ broke immediately after the finish line.
