Facts:

Following the running of Race 1, the MURRAY GRAY MEMORIAL TROT, an information was filed by Stipendiary Steward, Mr Munro, alleging that Mr Stratford, the driver of BIG IRON used his whip on more occasions than is permitted by the Use of the Whip regulations.

Mr Stratford signed the information indicating that he admitted the breach and did not wish to be present at the hearing of the Information.

Rule 869 provides as follows:

(2) No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.

The Use of the Whip Regulations provide:

(b) No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.

Mr Munro demonstrated on the race films that the respondent, who was racing outside the leader as the field entered the home straight, used his whip 11 times. These were all left-handed strikes. There was no respite until the near end of the race when it was evident that BIG IRON had the race won.

Mr Munro produced Mr Stratford’s record. He described Mr Stratford as “a sporadic driver”. Mr Stratford has had 6 drives this season and 2 last season. His record was clear under all rules.
