Facts:
It was alleged that Mr Reekie drove carelessly in the "Bishopdale/Bush Inn TAB's & Tavern Mobile Pace" by allowing his drive to shift outwards and placed "Data Base" in restricted room.
Shortly after the field turned for home, Mr Reekie, when looking for a line to run, shifted his drive outwards at least 3 cart widths. In the process, "Data Base" and one other horse on its outside were shifted outwards. The degree of outward movement was such, that it was rather surprising that none of the runners involved broke from their gaits. Mr Ydgren reported that the two horses affected were probably at the "end of their runs" and would not have finished in much better positions in any event. He said that in the opinion of the Stipendiary Stewards the chances of the other runners were not affected.
Mr Reekie elected not to be present at the hearing, but reported to Mr Ydgren, that "he was busy driving with the whip and reins at the time of the incident". He admitted his culpability at an early stage.
Submissions for Penalty:
Mr Ydgren said that Mr Reekie incurred a fine of $200 in April 2014 for careless driving, but other than that Mr Reekie has a good record as an Amateur horseman. The chances of the other runners were not affected. Mr Ydgren submitted that the matter could be dealt with by the imposition of a fine of $200.
Reasons for Penalty:
The Judicial Control Authority's Penalty Guide provides a starting point of a fine of $400 or a suspension of 8 drives. Against that, we take into account aggravating and mitigating factors.
In this case there is an aggravating factor in that Mr Reekie has a previous breach of this rule, even though the fact situation in his previous breach was different. The fact situation in that case was that he caused a horse to break from its gait. That warrants an uplift on the starting point of $50. Against that we consider that the mitigating factors are that the chances of the other runners were not affected, as neither of the other two runners or Mr Mr Reekie's horse broke from their gaits. Mr Reekie is an Amateur horseman, and otherwise has a good record. He also admitted the breach at an early stage. These mitigating factors afford Mr Reekie a discount of $200 on the starting point.
