Decision:

Accordingly, after considering all of the above facts, we find the charge proved.

Penalty:

Accordingly, we suspend Mr Cooksley from riding in races, which is to start after racing on 6 January and conclude after racing on 14 January 2012 (4 days).

Charge:

Careless Riding.

Facts:

Following race 3, an information was filed pursuant to rule 638 (1) (d). The informant, Mr Coles, alleged that near the 1100 metres, Mr G Cooksley, Rider of ENDORCEMENT, allowed his mount to shift in when not clear of HIDDEN KNIGHT (P Taylor), which was checked.

Submissions for Decision:

Mr Williamson demonstrated the video film and pointed out to the committee, Mr Cooksley riding ENDORSEMENT, racing in a 3 off position approaching the 1100 metres. Mr Williamson said that Mr Cooksley then moved into a 2 off position, taking the line of HIDDEN KNIGHT when a bare length clear.

Mr Coles called Mr Taylor, Rider of HIDDEN KNIGHT, who conceded that he received a slight bump and was crowded for a short distance. He stated that he lost 1 length as a result, but said that his mount did not help because it did not want to be there.

Mr Cooksley, in his defence, said that Mr Ormsby’s mount, which was on the rail, rolled out a half horse width, which contributed to the interference.

Mr Coles, in summing up, said that Mr Cooksley had come from a 3 wide position, to one of 2 wide when insufficiently clear. He conceded that there was some outward movement from the outside, and the committee had to decide how much this contributed to the interference.

Reasons for Decision:

The committee carefully considered all of the evidence and submissions as presented. After reviewing the films, we are satisfied that Mr Cooksley moved in from a 3 wide position to a 2 wide position when not sufficiently clear of HIDDEN KNIGHT. This resulted in Mr Taylor having to check his mount and lose momentum. We concede that there was some outward from Mr Ormsby’s mount, but we find that to be minimal.

Submissions for Penalty:

Mr Coles stated that Mr Cooksley had a very good record with 2 charges in the last 12 months. He submitted this charge was at the low end of carelessness, and reminded the committee that Mr Cooksley was suspended up to and including 6 January 2012, from a previous charge.

Mr Cooksley had nothing to say regarding penalty.

Reasons for Penalty:

The committee carefully considered the penalty submissions as presented. Mitigating factors are Mr Cooksley’s very good record and the contribution to the incident by Mr Ormsby’s mount, albeit slight. However, the aggravating factor is that Mr Cooksley did allow his mount to shift in when insufficiently clear. Taking all of the above facts into account, we find Mr Cooksley’s carelessness to be at the low end.
