The Committee ruled that MIDNIGHT IN MEMPHIS was not denied a fair start.
Facts:
Following the running of Race 3, an Information requesting a ruling was filed by Licensed Open Driver Mr J Cox, the driver of MIDNIGHT IN MEMPHIS in the race, to determine whether MIDNIGHT IN MEMPHIS was denied a fair start.
Rule 213 provides as follows:
(1) A Stipendiary Steward at any time may scratch from a race or declare ineligible to start in a race until a specific condition is met any horse on all or any of the following grounds: -
(J) If a horse was denied a fair start and such occurrence materially prejudiced the chances of that horse.
Submissions for Decision:
Mr Williams with the assistance of Mr Renault used the available race films to show MIDNIGHT IN MEMPHIS who was drawn the outside of the front line. He pointed to Mr Cox drive his horse up to the barrier and stand. He said the Stewards acknowledge MIDNIGHT IN MEMPHIS has ducked its head down a time or two while waiting for the field to be released. Mr Williams' assessment was that MIDNIGHT IN MEMPHIS had every opportunity to begin with the field.
Mr Cox using the video explained his horse had been standing while most of the field were walking towards the barrier. He said he called to the Starter to hold the start as he felt with his horse ducking its head and reefing, plus that most of the field were walking in and he was standing still, placed him at a disadvantage.
Reasons for Decision:
The Committee carefully considered all the evidence and viewed the available films.
In assessing the prestart in respect of MIDNIGHT IN MEMPHIS, there were no outside influences that hindered its progress before the barrier was released. A starter's assistant had held the horse for a moment but had moved away well before the start.
It is the Committee’s opinion that the horse’s demeanour and manners, not an unfair start, resulted in its tardy beginning.
