As Mr Lee has admitted the breach, it is found to be proved.

Mr Lee is fined the sum of $300. Mr Renault was asked to remind Mr Lee of his obligations under the rule as this was only his third drive since his previous breach of this rule.

Facts:

Mr Renault, Stipendiary Steward, alleged that Mr Lee when driving BIGANDME in race 10, the FRANKS MOTORCYCLES & 4 SPARES Mobile Pace, used his whip on more occasions inside the final 400 metres than is permitted by cl (b) of the Use of the Whip Regulations.

Mr Renault demonstrated on the videos that the respondent was racing back of mid field and used his whip 16 times in the last 400 metres.

Mr Lee indicated on the information that he admitted the breach and did not wish to be present at the hearing.

Mr Renault produced the respondent’s record. Mr Lee had 4 drives last season, and has had 3 drives this season.

The count for Mr Lee is 16. Mr Renault tells us Mr Lee agrees that this is the number. We note the strikes were broken up. There were pushes through the tail both at the candy pole and over the last 100 metres.

BIGANDME finished in 7th place.

Reasons for Penalty:

Mr Lee has a clear record under this rule for the past six months with his previous breach being on 17 March last. The penalty is thus reset. The Penalty Guide provides a $300 fine where the number of strikes is between 14 and 16 (mid-range) and the respondent has a clear record. There are no aggravating or mitigating factors that require an adjustment to this starting point.
