Facts:
Following the running of Race 3 (Levin TAB & Sports Bar 1200), Information No.A12261 was filed with the Judicial Committee. It was alleged by the Informant that Mr C Lammas the rider of OUTTHEGATE used his whip excessively prior to the 100m.
Rule 638(3)(b)(ii) provides:
A rider shall not strike a horse with a whip in a manner or to an extent which is:
(ii) excessive
Mr Lammas said that he understood the Rule, charge and confirmed to the Committee that he admitted the breach.
Mr Goodwin showed the film replays and said that Mr Lammas had struck his horse with the whip no less than 10 times prior to the 100m. He said that although there was the odd pause between the strikes, the whip use by Mr Lammas was outside the whip guidelines.
Mr Lammas agreed with the number of strikes being no less than 10. He said that the softer track had made a difference and that he was trying a little too hard. He added that he had made a mistake by miscounting the strides.
Submissions for Penalty:
Mr Goodwin said that Mr Lammas’ record showed one prior breach of the Rule, that being on 29.08.18 when a $300 fine was imposed. He said that due to Mr Lammas’ excellent record a fine would be a suitable penalty.
Mr Lammas said that this was only his second whip charge during his riding career which proved he had a very good record. He added that he had breached the Rule and had to accept the consequences.
Reasons for Penalty:
The Committee gave due regard to all submissions. Taking into account Mr Lammas’ excellent record, the admission of the breach, the JCA penalty guidelines and that the breach was the second within a 12 month period it was determined that a fine of $500 was an appropriate penalty.
