Facts:
Following the running of Race 5 (Woburn Farm 2yo Classic – Group 3) Information No. A14125 was filed with the Judicial Committee. It was alleged that Mr Bosson weighed in 0.8kg above the weight in which he had weighed out.
Mr Bosson said that he understood the Rule, Charge and confirmed that he admitted the breach.
The Committee heard from Mr Barron, the Clerk of Scales, who said that Mr Bosson weighed out at 57.9kg and weighed in at 58.7kg, which was 0.8kg over his weigh-out weight. Mr Barron added that he checked the gear at weigh-out time and that it was all there.
Mr Bosson did not have any questions of Mr Barron.
Mr Bosson for his part said that he did not change any gear but that he had drunk too much water after weighing out.
Mr Bosson said that he tried to get off the horse earlier in the week and again on the morning of the Races, but was told by a connection “to get down there and do the best you can”.
Mr Bosson said that when you are wasting hard and have a drink the weight goes on quickly.
It was brought to the attention of the Committee that following racing on 30 January 2021, that it was agreed with the Stewards and Mr Bosson that he would not be able to accept rides under 57.5kg without first obtaining permission to do so. As QUATTRO QUINTA was carded to carry 56.5kg permission was sought by the Trainer of the horse for Mr Bosson to take the ride with approval being given by the Stewards.
Submissions for Penalty:
Mr Goodwin said that in April 2019 at Randwick Mr Bosson weighed in overweight and was fined $500. Mr Goodwin said that Mr Bosson has had a number of weight issues and at Trentham on 30 January 2021 Mr Bosson was warned for being overweight on weighing in following his ride on Melody Belle.
Mr Goodwin added that it did not look good for Mr Bosson going on the issues he has had and said that a fine would be an appropriate penalty.
Mr Bosson said that he had a pretty good record on weighing in and asked for a fine only.
Reasons for Penalty:
No discount was given for the admitted breach as being overweight is factual and would be nigh on impossible to defend.
In the opinion of the Committee the aggravating features are many and are listed as follows:
1)-Warned for being overweight on weighing in following his ride on Melody Belle at Trentham on 30 January.
2)-Mr Bosson has had several weight-related breaches. Since 31 March 2018 Mr Bosson has had 13 breaches for weight-related matters, excluding warnings from Stipendiary Stewards.
3)-Mr Bosson’s record is concerning and at best could be described as unenviable.
4)-Punters, who are the lifeblood of racing, expect and are entitled to believe that the weight a Jockey weighs out at will be the same as when he weighs in following the race.
5)-The overweight breach occurred in a Group 3 event.
Taking all matters relating to penalty into consideration, including the JCA Penalty Guide starting point of $200, the Committee determined that a fine of $1,000 was a condign penalty.
