Accordingly, the protest was dismissed, and dividends were directed to be paid accordingly.

Facts:

Following Race 8 (Sportz Bar 2060),a protest was lodged pursuant to Rule 642(1) by Mrs Allpress alleging that horse number 9 (REVOLUTION) or its rider placed 1t by the Judge interfered with the chances of horse number 7 CORNERSTONE), placed 2nd by the Judge.

The information alleged interference in the home straight.
Judges placings were:
1st - REVOLUTION (9)
2nd - CORNERSTONE (7)
3rd - EN SUITE (10)
4th - NOM DU BEEL (4)

The official margin between first and second placed horses was 3 lengths.

Submissions for Decision:

Mrs Allpress told the Committee that she came from a position behind REVOLUTION and levelled up to the outside of that runner. Ms Hirini then let REVOLUTION drift outwards closing the gap on CORNERSTONE. Mrs Allpress said she lost 2 lengths because of the interference and had to try and get her horse balanced up again. Had her horse not been stopped, Mrs Allpress said he would have gone past REVOLUTION. She said the interference occurred at a vital stage of the race and once CORNERSTONE lost momentum Mrs Allpress said she didn’t see the point in pushing him hard to the finish. For this reason she urged the Committee to disregard the 3-length margin between the two horses.

Ms Kaye agreed with all Mrs Allpress said and emphasised that CORNERSTONE had all its momentum taken away, making it very difficult for the horse to get going again.

Mr Nelson, the trainer of the winner, said he didn’t think there was any way it could be proved that CORNERSTONE would have beaten REVOLUTION. He described the interference as minor and said his horse won easily by a 3-length margin.

Ms Hirini admitted that she caused some loss of momentum to CORNERSTONE but said she believed her horse was always travelling better.

For the Stewards Mr Balcombe showed where CORNERSTONE came up alongside REVOLUTION and for a few strides the two horses raced head to head. REVOLUTION then drifted outwards, causing interference to CORNERSTONE which had to be checked and come to the inside. While REVOLUTION finished very strongly the Stewards questioned Mrs Allpress’ actions in not riding her mount out vigorously to the line.

Reasons for Decision:

Rule 642(1) states:
If a placed horse or its Rider causes interference within the meaning of this Rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.

Mrs Allpress elected to take the outside running lane hard up against the fence but ran out of room when Ms Hirini allowed REVOLUTION to drift outwards near the 100m, effectively closing the gap. Mrs Allpress was forced to check and switch to the inside of Ms Hirini but never made any ground on REVOLUTION from that point through to the finish.

There is no doubt that CORNERSTONE lost momentum due to losing its rightful line of running however Rule 642(1) states that the Judicial Committee has to be satisfied that had the interference not occurred CORNERSTONE would have finished ahead of REVOLUTION.

Taking into account the official 3-length margin between the horses, the fact that REVOLUTION was finishing so strongly and CORNERSTONE only coasted to the line, we could not reasonably make a case for relegation.
