Facts:

An information was lodged by Mr Renault under 869(3)(b) alleging that Mr Williamson drove in a careless manner by allowing his horse SPIRIT OF CHRONOS to strike the sulky wheel of BETABEEASY (A Butt) with approximately 200 metres to run. This resulted in SPIRIT OF CHRONOS breaking.

Submissions for Decision:

Mr Renault demonstrated on the videos that shortly after turning for home, SPIRIT OF CHRONOS, which was in the one one position, went to move to the outside of the horse that he was trailing, BETABEEASY, and in so doing SPIRIT OF CHRONOS came into contact with the wheel of the cart of that horse. The consequence was that SPIRIT OF CHRONOS broke and lost all chance. Mr Renault stated there was only half a gap there when Mr Williamson went to improve as Mr Barron (UPANATOM) was improving swiftly on the outside of Mr Williamson.

Mr Williamson said his horse was travelling well and he was looking for a run. He said he had simply chosen the wrong time to move. Had he gone 50 metres earlier, he would have been “ok”. He added that UPANATOM had thrown in a few rough ones on the turn and he had not expected that horse to finish on again as quickly as he did, and he had been caught out for this reason.

Mr Smith stated there was half a gap there and it was a hard judgment call for Mr Williamson and he had just chosen the wrong time.

Submissions for Penalty:

Mr Renault produced Mr Williamson’s record, which he described as very good. Mr Williamson had 293 drives in the past season and had no breaches of this rule. He submitted a fine at the lower end was appropriate as the only horse affected was that driven by Mr Williamson.

Mr Smith emphasised Mr Williamson had “put his hand up” and had a very good record.

Reasons for Penalty:

We agree the breach is at the lower end of the spectrum. There was half a gap there for Mr Williamson and UPANATOM had simply made ground more quickly on his outer than he had anticipated. However, the connections of SPIRIT OF CHRONOS and those who had invested on the horse were affected by the respondent’s actions, in that the horse broke and lost its chance.

The Penalty Guide recommends a starting point of $400. From that point we make deductions for Mr Williamson’s excellent record, his ready admission of the breach and the fact that he is a junior driver.
