As SUSIES WAY has gained an advantage over the field, it is appropriate that the horse be disqualified.

Amended placings are:
1st - 3 DORA EXPLORER
2nd -1 KAHRESS
3rd - 11-WILLANGUS LAD
4th - 4-SUNNY VALLEY
5th - 6-WHANGAMATA

Stakes and dividends are to be paid accordingly.

Facts:

Mr Munro alleged that in Race 1 horse number 10, SUSIES WAY broke in excess of 50 metres in the final 200 metres of the race.

Mr Munro sought disqualification of SUSIES WAY pursuant to r 1003(2)

Judges placings were:
1st - 3 -DORA EXPLORER
2nd - 1 -KAHRESS
3rd - 11-WILLANGUS LAD
4th - 4-SUNNY VALLEY
5th - 10 -SUSIES WAY

Submissions for Decision:

Mr Munro demonstrated on the videos that SUSIES WAY was not in her proper gait for some 100 metres in the home straight. The mare paced passing the 200 metres and she had to be restrained into a break for some distance to return her to her correct gait.

Mr McIlwrick, the driver of SUSIES WAY, represented the connections and did not contest the protest.

Reasons for Decision:

After viewing the videos from the various angles, the Committee is satisfied that SUSIES WAY was not in her proper gait for a distance in excess of 50 metres in the final 200 metres. SUSIES WAY was free of interference at the time. The breaking horse regulations are clear in that the horse is deemed to be in breach of r 870(3) in that she has failed to promptly regain her proper gait.
