Accordingly after taking all the facts listed above into account we order Mr Eynon to ride CAPE KINAVERAL in the Great Northern Steeplechase.
Facts:
The informant, Mr A Coles, sought a ruling regarding a disputed riding engagement in Race 7, the Rodd and Gunn Great Northern Steeplechase.
Mr J Wheeler and Mr G Rogerson both believed they had engaged Mr R Eynon to ride their respective horses in that race.
Submissions for Decision:
Mr J Wheeler, trainer of VOLKSWAGIN, said he was in no doubt that Mr Eynon had made a firm commitment to ride VOLKSWAGIN in the Great Northern Steeplechase when he was asked on 30th August. He was aware of a loose arrangement regarding Mr Eynon riding CAPE KINAVERAL in that race also but said you cannot make a firm engagement 3 weeks prior to the race which Mr Rogerson is claiming.
Mr Eynon admitted he said yes to Mr Wheeler regarding the mount on 30th August.
Mr G Rogerson is adamant that he engaged Mr Eynon to ride CAPE KINAVERAL in the Great Northern Steeplechase 2 days following the Grand National meeting at Riccarton. He said there was contact between himself and Mr Wheeler regarding the engagement of Mr Eynon for the ride at that time.
Mr M Gregory said that he asked Mr Eynon on 24 August if he was still committed to CAPE KINAVERAL in the Great Northern and Mr Eynon said yes.
Reasons for Decision:
The committee carefully considered all the evidence and submissions as presented. We are satisfied that Mr Rogerson made the initial contact with Mr Wheeler regarding the ride on CAPE KINAVERAL. This engagement was followed up by Mr Gregory and contact was maintained through the period from the Grand National meeting until the dispute arose. This is a critical factor in our decision. This whole dispute arose through Mr Eynon saying to Mr Wheeler on 30 August he would take the ride on VOLKSWAGIN in the Great Northern. Mr Wheeler said in his evidence you cannot confirm a riding engagement in a jumping race 3 weeks in advance. However because Mr Eynon said 3 weeks before the race he would ride CAPE KINAVERAL and because contact between the CAPE KINAVERAL camp and Mr Eynon had been maintained we find in favour of Mr Eynon taking the mount on CAPE KINAVERAL.
In conclusion the committee voiced its disappointment to the parties concerned that this dispute had arisen. It highlights the importance of clear communication to avoid any misunderstandings such as this.
