Submissions for Decision:
Mr Ydgren had Mr Allison, stipendiary steward, demonstrate on the video that NEW YEARS JAY broke for some 175 metres immediately after the dispatch. He pointed out the track marker, which was 150 metres after the start, and said that NEW YEARS JAY galloped for a further 20 to 25 metres after this point.
Mr D Dunn, the driver of NEW YEARS JAY, stated that he represented Mr Simpson and that he did not wish to contest the protest.
Reasons for Decision:
In exercising our discretion under r 1003(2) to disqualify NEW YEARS JAY we are satisfied that the horse broke for over 170 metres immediately after the start.
