At the conclusion of Race 9, The Alabar Cromwell Cup Handicap Pace an Information was lodged by Stipendiary Steward, Mr S Renault instigating a protest into the fourth placed horse by the judge ULTRA SHOK (D Dunn) who broke in excess of 50 metres in the home straight.
The rule reads 870 (3) and breaking horse regulations:
Any horse which breaks from its gait shall promptly regain its proper gait.

Stipendiary Steward, Mr Renault showed the relevant film of the incident, highlighting ULTRA SHOK (D Dunn) breaking just prior to the 50 metre mark from the winning post, and settling down again into a pace just prior to the winning post. Mr Renault acknowledged that the camera angles made it very difficult to pin point the exact point where ULTRA SHOK went into a break.
Mr D Dunn, the driver of ULTRA SHOK said it was simply impossible to tell by the video clips of the incident when his horse went into a break. Mr Dunn believed his horse settled back into a pace about 4 or 5 metres from the winning post.
Reasons for Decision:
We carefully considered the submission given and the video coverage of the incident. The committee was satisfied that it could not determine the exact point where ULTRA SHOK broke, due to the camera angles as they were presented around the 50 metre mark from the winning post.
It was agreed by all parties that ULTRA SHOK returned to its gait about 4 or 5 metres from the winning post.
